Returns and complaints
— COMPLAINTS
- Complaints should be submitted in writing to the address: Zacisze Anioła Palarnia Kawy Kawiarnia Sp. z o. o., ul. Ottona z Pilczy 21, 37-100 Łańcut, or electronically to biuro@kawiarnia-aniola.pl.
- It is recommended that the complaint include a concise description of the defect, the circumstances (including the date) of its occurrence, the customer’s details, and the customer’s request related to the defect of the product.
- The seller will respond to the complaint request promptly, no later than within 14 days. If the seller does not respond within this period, the complaint is considered justified.
- Products returned as part of the complaint procedure should be sent to the following address: ul. Ottona z Pilczy 21, 37-100 Łańcut.
- If a product comes with a warranty, information about the warranty and its terms will be included in the product description in the store.
— RIGHT OF WITHDRAWAL FROM THE CONTRACT
- A consumer has the right to withdraw from a Sales Agreement within 14 days without giving any reason.
- The withdrawal period begins on the day the Product is delivered to the Consumer or a third party indicated by the Consumer, other than the carrier.
- For an Agreement that includes multiple Products delivered separately, in batches, or in parts, the withdrawal period begins from the delivery of the last item, batch, or part.
- For an Agreement that involves the regular delivery of Products over a defined period (subscription), the withdrawal period begins from the possession of the first item.
- The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. It is sufficient to send the statement before the withdrawal period expires.
- The statement can be sent by traditional mail, fax, or electronically to the Seller’s email address or by submitting the statement on the Seller’s website.
- If the statement is sent electronically, the Seller will immediately confirm receipt of the statement to the Consumer via the email address provided.
Effects of withdrawal from the Agreement:
- Upon withdrawal from the Agreement concluded remotely, the Agreement is considered null and void.
- In the event of withdrawal from the Agreement, the Seller shall promptly, no later than 14 days from the receipt of the Consumer’s statement of withdrawal, refund all payments made by the Consumer, including delivery costs, except for additional costs resulting from the Consumer’s chosen delivery method, which differs from the least expensive standard delivery method offered by the Seller.
- The refund will be made using the same payment method used by the Consumer in the original transaction, unless the Consumer expressly agrees to another method that does not incur any costs for them.
- The Seller may withhold the refund until the Product is returned or until proof of its return is provided, whichever occurs first.
- The Consumer must return the Product to the Seller’s address no later than 14 days from the day they informed the Seller of the withdrawal. The deadline is met if the Consumer sends the Product before the 14-day period expires.
- The Consumer bears the direct cost of returning the Product, including return shipping costs if, due to the nature of the Product, it cannot be returned by regular mail.
- The Consumer is only liable for any diminished value of the Product resulting from its use beyond what is necessary to establish its nature, characteristics, and functioning.
- If the nature of the Product makes it impossible to return by regular mail, information about this and the cost of returning the Product will be included in the Product description in the Store.
The right of withdrawal from a distance contract does not apply to the Consumer in the following cases:
- The subject of the service is a non-prefabricated item, made according to the Consumer’s specifications or serving to meet their individual needs.
- The subject of the service is an item delivered in sealed packaging, which, after opening, cannot be returned for health protection or hygiene reasons, if the packaging was opened after delivery.
- The subject of the service is an item that is prone to rapid deterioration or has a short shelf life.
- The provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the provision began that after the service was completed, they would lose the right to withdraw from the Agreement.
- The price or remuneration depends on fluctuations in the financial market, over which the Seller has no control, and which may occur before the withdrawal period expires.
